DMCA / Copyright Policy

PetAdoptNow respects intellectual-property rights and complies with the United States Digital Millennium Copyright Act of 1998 (the “DMCA”). This page explains how to submit a notice of claimed infringement, how to submit a counter-notice if you believe material was removed in error, and how we handle repeat infringers.

1. Notice of claimed infringement

If you believe material accessible on petadoptnow.com (the “Site”) infringes a copyright you own or are authorized to enforce, you may submit a written DMCA notice by email to [email protected] with the subject line “DMCA Notice”. To be effective under 17 U.S.C. § 512(c)(3), the notice must include all of the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of those works;
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material — including the full URL of the page on petadoptnow.com;
  4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address;
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  6. A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Knowingly submitting a misrepresentation in a DMCA notice may subject you to liability under 17 U.S.C. § 512(f).

2. Counter-notice

If you believe material that we removed (or to which access has been disabled) was identified as infringing in error or as a result of misidentification, you may submit a counter-notice by email to [email protected] with the subject line “DMCA Counter-Notice”. Under 17 U.S.C. § 512(g)(3), the counter-notice must include all of the following:

  1. Your physical or electronic signature;
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, and telephone number;
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which the Site may be found) and that you will accept service of process from the person who submitted the notice or an agent of that person.

We will forward your counter-notice to the original complaining party. If we do not receive notice within 10 to 14 business days that the complaining party has filed an action seeking a court order to restrain the activity, we may replace or re-enable access to the material.

PetAdoptNow is operated from Hong Kong. Although the DMCA is a United States statute and does not, on its face, govern non- U.S. operators, we voluntarily adopt this notice-and-takedown procedure to address concerns raised by U.S. rights-holders promptly and in good faith.

We respond to properly-formatted notices within a commercially reasonable time, typically within 5 business days.

4. Repeat infringers

We will, in appropriate circumstances, terminate access for users we determine in our reasonable discretion to be repeat infringers.

5. Pet photographs

Pet photographs on the Site are sourced from the originating shelter or rescue organization and are credited on each detail page. If you are a shelter staff member, photographer, or rights holder and we are displaying a photograph in a way that violates your rights, please use the DMCA notice procedure above and we will respond promptly. Where appropriate, we will prefer correction (adding or fixing an attribution) over removal, but the choice is the rights-holder’s.

6. Modifications

We may update this DMCA Policy from time to time. The “ Last updated” date at the top of this page indicates when changes were last made.
